In revolutionary France, 1789 became Year One in the new constitutional order. No comparable event occurred in Canada with the adoption of the Constitution Act, 1982. While the Charter and the protection of Aboriginal and treaty rights are significant, in most respects Canada’s constitutional order continued as before. Comprehending that constitutional order requires understanding how it developed, starting with the perspective of 1867.
